These General Conditions of Sale (GCS) govern all sales made on the site www.soleyahjewelry.com , operated by Soleyah , a sole proprietorship based in Montreal, Quebec, Canada.
Any order placed on the site implies full and complete acceptance of these conditions.

1. Purpose

These General Conditions of Sale (GCS) define the rights and obligations between Soleyah and its customers in the context of the online sale of handmade and personalized jewelry on the site www.soleyahjewelry.com .

3. Products

The jewelry offered for sale on the site is described and photographed with the greatest care. Slight differences in color, size, or finish may exist due to the handcrafted nature of the product.

Some jewelry is personalized (necklaces and charm bracelets). These items cannot be returned or exchanged , except in the case of a manufacturing defect. Any defect must be proven by email before any return is possible.

Product availability is indicated on the website. In the event of exceptional shortages, the customer will be informed by email.


4. Price

The prices displayed on the site are indicated in Canadian dollars (CAD), all taxes included (TTC) .

For your convenience, the website also allows you to view and pay in USD (US dollars) and EUR (euros). In this case, the final amount debited will depend on the exchange rate applied by the customer's bank or payment provider.

Delivery charges, if applicable, are indicated during the ordering process and added to the total amount to be paid.

Soleyah reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time of the order.


5. Orders

The customer can place an order directly on the website by following the online ordering process.

Any order implies:

  1. Selecting products and adding them to the basket.
  2. Validation of the basket and entry of delivery and billing information.
  3. The choice of payment method.
  4. Full payment of the order.

Once the order has been validated and paid, the customer receives an order confirmation email , which serves as proof of purchase and summarizes the details of the order.

The order is considered final only after receipt of payment.

Soleyah reserves the right to refuse or cancel any order in the event of a payment problem, suspicion of fraud, or in the event of exceptional unavailability of the product.


6. Payment

Payment for purchases is made online, at the time of ordering, using one of the following payment methods accepted on the site:

  • Bank cards: Visa, Mastercard, American Express, CB
  • PayPal
  • Apple Pay

Payments are processed through Shopify's secure platform and/or its service providers.
👉 At no time does Soleyah have access to the customer's banking information.

The order is only considered validated after authorization of the payment by the bank , then manual validation of the payment by Soleyah .

In the event of refusal of payment by the banking establishment or suspicion of fraud, Soleyah reserves the right to cancel the order without shipment.


7. Delivery

Soleyah offers several delivery methods:

  • Standard and express delivery via carrier (delays vary depending on the destination).
  • Local home delivery (available for certain areas of Montreal), made within a maximum of 48 hours following the order .

Delivery costs and times are specified during the order process before validation and payment.

Deliveries are made within Canada and internationally . Delivery times may vary depending on the destination and carrier conditions.

Soleyah cannot be held liable for any delay attributable to the carrier, postal services, customs or any circumstance beyond its control.

The transfer of risks relating to the products takes place upon delivery of the package to the carrier or upon local delivery.

The customer is responsible for providing a complete and accurate address. In the event of an error or incomplete address, the customer will be responsible for return shipping costs.


8. Returns and exchanges

8.1 Time limits and general conditions

  • Exchange requests must be made within a maximum of 14 days of receipt of the order .
  • Jewelry must be new, unworn and returned in its original packaging .
  • Return costs are the responsibility of the customer , except in the case of a manufacturing defect.

8.2 Products excluded from returns

  • Personalized jewelry (custom-made charm necklaces and bracelets) cannot be returned or exchanged, except in the event of a manufacturing defect.
  • Items on sale or on sale are not returned or exchanged.

8.3 Procedure

  • Before any return, the customer must complete the online return form available on the site in order to inform Soleyah of their request.
  • If the return is accepted, Soleyah will send the customer a PDF document to print and attach to the package .
  • ⚠️ Any package returned without this document cannot be processed.
  • In the event of a manufacturing defect, the customer must inform Soleyah by email and provide proof (photo/video) before any return.
  • If the defect is confirmed, Soleyah will refund the initial delivery costs of the order (excluding return costs, which remain the responsibility of the customer).

8.4 Refunds

  • Soleyah does not make refunds , except in the case of defective products.
  • In all other cases, only an exchange is offered, subject to availability.


9. Legal guarantees

In accordance with the legislation in force in Quebec and Canada, the products sold by Soleyah benefit from legal guarantees of quality and conformity .

In the event of a defective product or one that does not conform to the description, the customer must contact Soleyah by email and provide proof (photo/video) of the defect observed.

After verification, Soleyah will proceed either with an exchange or with an exceptional refund if the exchange is impossible.

⚠️ The warranty does not cover:

  • normal wear and tear of jewelry,
  • damage resulting from improper use (e.g. exposure to chemicals, shocks, improper maintenance).

✨ Soleyah jewelry is made of high quality stainless steel , water resistant and not easy to tarnish.

ℹ️ Concerning the care of jewelry , all recommendations are specified in the FAQ – “Caring for my jewelry” section available on the site.


10. Intellectual Property

All elements of the site www.soleyahjewelry.com are and remain the intellectual and exclusive property of Soleyah.
This includes, but is not limited to:

  • the photographs,
  • the visuals,
  • the texts,
  • the logo and graphic charter,
  • as well as the creations and models of jewelry presented.

Any reproduction, exploitation, distribution or use of these elements, even partial, is strictly prohibited without the prior written authorization of Soleyah.

Furthermore, Soleyah jewelry designs and creations may not be copied, reproduced or manufactured by third parties for commercial or personal purposes without express permission.


11. Liability

Soleyah makes every effort to ensure the accuracy and updating of the information presented on the site.
However, minor errors may remain (for example in descriptions, photos or prices), and Soleyah cannot be held responsible for these discrepancies.

Soleyah cannot be held responsible under any circumstances:

  • inappropriate or misused use of the jewelry by the customer,
  • damage resulting from lack of maintenance,
  • possible allergic reactions related to materials (although stainless steel is hypoallergenic, individual sensitivity may exist),
  • temporary interruptions or malfunctions of the site,
  • delays, losses or damages related to carriers or postal services.

Soleyah's liability is in any event limited to the amount of the order placed by the customer.


12. Applicable law

These General Conditions of Sale are governed by the laws in force in the province of Quebec and, more generally, by the laws applicable in Canada .

In the event of a dispute, an amicable solution will be sought as a priority.
Failing agreement, any dispute will be submitted to the exclusive jurisdiction of the courts of the province of Quebec, Canada.

The customer may also, if he wishes, contact the Office de la protection du consommateur (OPC) in Quebec for any complaint or mediation.
